These Terms of Service (“Terms”) apply to the web design, hosting, domain, and related services provided by ProForge (“ProForge,” “MyProforge,” “we,” “us”) through www.myproforge.com and billing.myproforge.com. By ordering or using our services, you agree to these Terms.
1. Services
We design, host, and maintain websites, register and manage domains, and provide related services for trade businesses. The features in each package (Starter, Builder, and Master) are described on our Website Packages page. Domain email is provided by Google Workspace. As a Google partner, we set it up and bill it through your ProForge account. Google’s terms also apply to the email service.
2. Pricing and billing
Each package has a monthly subscription fee and a one-time setup fee. Current pricing is listed on our Website Packages page. Subscriptions renew monthly and are billed in advance through your account at billing.myproforge.com. Card payments are processed by a third-party payment processor. If a payment fails, we may pause your services until the balance is paid.
3. 100% Satisfaction Guarantee
If you’re not satisfied within the first 30 days after your site goes live, tell us. We’ll work with you to make it right. If we can’t, we’ll refund what you paid, including the setup fee.
- The guarantee is limited to one refund per customer.
- It does not apply to abuse, such as repeated sign-ups to get free work, requests outside the scope of your package, or breaking these Terms.
- Domain registration fees paid to third-party registrars may not be refundable.
4. Cancellation
After the first 30 days, you can cancel anytime. Cancellation takes effect at the end of your current billing period. We don’t give refunds or credits for partial billing periods.
5. Your content and domain
You own the content you provide (text, photos, logos, and other business information) and your domain. Domains we register for you are registered in your name. If you cancel, we will help you keep control of your domain, and we will not charge you to transfer it to your own registrar account. On request, we will provide a copy of the content you supplied (for example, your text and images).
On Builder and Master plans, we create a Google Analytics property for your site under a ProForge-owned Google account and add the tracking tag to your site. You can see summary stats in your billing dashboard, and we can give your own Google email access to the property. If you cancel, we’ll transfer your Google Analytics to your Google account on request. Unclaimed data is deleted 90 days after cancellation. If you connect your own Google Analytics instead, we archive the ProForge property 30 days later.
You confirm you have the right to use any content you give us, and you’re responsible for the accuracy of your site’s content.
6. Intellectual Property and License
ProForge owns all rights, title, and interest in the website designs, templates, layouts, code, graphics we create, and the built-in features and tools we provide (together, the “ProForge Materials”). Nothing in these Terms transfers ownership of the ProForge Materials to you.
While your account is active and in good standing, we grant you a limited, non-exclusive, non-transferable license to use the ProForge Materials only on the website we host for you under your ProForge account. You may not sell, sublicense, or assign that license.
You own your content (text, photos, logos, and other business information you provide) and your domain. You grant ProForge a license to host, display, and otherwise use that content as needed to provide the services.
If your account is cancelled or terminated, your license to the ProForge Materials ends. You may not copy, export, reproduce, or host the ProForge Materials on another platform, or have a third party do so. We will provide your content (for example, text and images you supplied) on request. You agree to sign a release confirming that you will not copy or self-host the ProForge Materials after cancellation. Domain transfer to your own registrar account is free, as described in section 5.
7. Acceptable use
You may not use our services to host or send:
- Illegal content, or content that infringes someone else’s rights.
- Spam or unsolicited bulk messages.
- Malware, phishing, or anything that harms other systems or users.
We may suspend or remove content or services that break these rules.
8. Hosting and availability
We work to keep your site fast, secure, and online, and we keep daily backups. Like any online service, occasional maintenance or issues outside our control can affect availability. We will make reasonable efforts to restore service quickly, but we do not guarantee uninterrupted service.
9. Limitation of liability
To the extent allowed by law, ProForge is not liable for indirect, incidental, or consequential damages, such as lost profits or lost business. Our total liability for any claim is limited to the amount you paid us in the 3 months before the claim.
10. Changes to these Terms
We may update these Terms. When we do, we’ll change the “Last updated” date above. Continuing to use our services means you accept the updated Terms.
11. Governing law
These Terms are governed by the laws of the State of [STATE], without regard to its conflict-of-law rules.
